You Qualify for Expanded DAPA if you meet the following requirements:
1. You were born on November 20, 2014 or before that date and you are a parent of a US citizen or permanent resident
2. You have lived in the US since January 1, 2010 ;
3. You were present in the United States on both November 20, 2014 and the date you requested Deferred Action;
4. You did not have legal immigration status in the United States on November 20, 2014;
5. You present and pass a review of security and criminal records.
Qualifications for Expanded DACA: The majority of Expanded DACA requirements have not changed, but there are some changes that could permit more people to qualify. These are the changes to the Expanded DACA program;
1. There is no longer any age limit. If you were previously told you were too old to qualify for DACA , you may now qualify, as long as you meet the other requirements .
2. The President changed the time you must have lived in the United States to qualify for DACA . Before, you had to prove that you lived in the US since June 15 , 2007. Now , you may qualify for DACA, if you have lived in the United States since January 1, 2010 .
3. DACA and the work permit shall now be valid for three years. As of November 24, 2014, persons applying for DACA for the first time or to renew DACA, receive deferred action and a work permit for three years. If you were already approved for DACA , your work permit is valid for two years. You must keep up with the latest information from the government concerning the possible extension of your existing DACA to three years.
4. If you have ever been arrested or convicted of a crime, have been associated with gangs , or if you are unsure of your criminal record, you should obtain a copy of your criminal records and talk with an attorney to see if you are eligible for DACA .
